Baseball season is underway and if you are a fan, you know three things: baseball cannot be played alone (very well anyhow), it takes time for a game to develop and the team that works best together usually wins.

Since the beginning of the year, the “team” (your board of directors), has been playing to win with regard to the needs of the membership in these uncertain times. You will recall the announcements of the transitional membership, the decision not to increase dues or fees at a time when revenue is declining, and, as a culmination of these efforts, we partnered with Right Management to offer outplacement service workshops to those in transition.

We have had several HR Professionals in transition take advantage of these programs and the first outplacement series of workshops was completely full with a wait list. Those not able to attend the first round due to space constraints are being offered a second session so they too can benefit.

So as the season gets into full swing, we continue to “Serve the Professional” by rallying the team, planning a long term strategy for this year’s match-ups, and delivering one win after another as we focus on the prize of another great year of HR service and support where it’s needed most.

Thanks to everyone involved and the membership as a whole as this effort has resulted in a home run in the 2009 season!

The Ambassador Program is looking for volunteers to be Ambassadors. If you’ve been a member of HRACI for at least a year and you would like to take some time to get a new member acclimated to the association, this is the opportunity for you! Ambassadors are assigned a new member (or a few members, depending on your availability) and make contact with that new member to give them information on HRACI and to make them feel welcome. HRACI is researching how to offer corporate memberships to companies that have seven or more members of HRACI. If you have ideas on how this program should look, please contact Pam Dolas, VP of membership at membership@hraci.org.

HRACI is offering transitional memberships to those HR professionals who are unemployed at the time of enrollment. The cost is $62.50, half the cost of a regular membership. Volunteer Update: HRACI Seeks Your Outstanding Human Resource Professionals Nominations

It’s again the time of year when HRACI is asking for your nominations for outstanding Human Resource Professionals. Each year, HRACI presents an award to the Volunteer Leader of the Year and the Professional of the Year. HRACI is collecting nominations for both of these awards through June 26, 2009. We will then select the winner from all of the nominees and they will be presented with their award at our July luncheon.

The winner of each category will receive their award, free admission to the July luncheon and free admission to the Indiana State HR Conference. Our local HRACI winners will also be nominated for and represent HRACI for the state awards of the same name. The state winners will then be announced at the Indiana conference.

We are very excited about our increased participation and nominations over these past years and look forward to more outstanding nominations this year. This is a great way to give praise to an employee, recognize hard work and let someone know that their efforts have been noticed. Please nominate your friend, colleague or even yourself for one or both of these awards today! You do not need to be a member of HRACI to submit a nomination and you can remain anonymous. The National Defense Authorization Act received much press last year when it added two new kinds of military-related FMLA leave. You may know that the Department of Labor issued regulations implementing those changes in early 2009.

But do you know the ins and outs of these new regulations? Are you in compliance? The regulations both answer and create many questions to tackle as you respond to FMLA requests and administer leaves.

What's more, the DOL thoroughly overhauled its existing regulations for non-military FMLA leave for the first time since 1993. New rules now govern employer/employee notices, certification, recertification, contacts with health care providers, and more. The new regulations are in effect now, so now is the time to learn them inside and out!

Legislative Update: Winding Down at the Indiana General Assembly

Indiana legislators returned to the State House in January to begin the 2009 session of the Indiana General Assembly. The 2009 legislative session was a "long session." In odd-numbered years such as 2009, the General Assembly begins its work in January and must adjourn by April 29. These sessions, lasting approximately four months, are called "long sessions." The General Assembly is required to adopt the state's two-year fiscal budget during the long session. In alternating even-numbered years, the General Assembly holds "short sessions" lasting about two-and-a-half months. The "short session" begins in January and adjourns no later than March 14 under Indiana law.

With April 29 approaching, the 2009 long session is drawing to a close this week. The Legislative Committee previously targeted four bills for tracking in this session of the General Assembly, in each case opposing passage of the bills. The targeted bills included the following:

    1. A bill to require employers to allow employees to bring firearms onto the employer's premises.
    2. A bill to create a family leave requirement similar to the Family and Medical Leave Act (FMLA) for small Indiana employers.
    3. A bill to create a state version of an age discrimination law similar to the already-existing federal Age Discrimination in Employment Act (ADEA).
    4. A bill to punish Indiana employers -- including the possibility of closing down the business -- for violations of federal immigration laws.
As we approach the end of the 2009 session, it appears that each of the four targeted bills has been defeated in the Indiana General Assembly. Each of the bills has not received the votes necessary to pass as stand-alone bills. While it is possible that the concepts behind each of the bills could be amended into other legislation, it does not appear at this writing that any such amendments will take place.

The remaining legislation pending in the General Assembly that is certainly of interest to employers is legislation to fix Indiana's Unemployment Insurance Trust Fund. As reported in a previous newsletter, Indiana has been forced to borrow from the federal government (as much as $1 billion this year) to prop up the fund. Current legislation proposed to make the fund solvent includes provisions for increased employer taxes paid into the fund, the possibility of decreased benefits, and tightening eligibility restrictions to receive unemployment benefits. Because differing versions of bills to deal with this issue passed the Indiana House of Representatives and the Indiana Senate, a joint House and Senate Conference Committee will meet this week to attempt to negotiate a compromise between to the two versions of the bills.

Certification Update: Let HRACI Know About Your PHR/SPHR/GPHR Certification

You can now notify HRACI of your PHR/SPHR/GPHR certification. Just go to www.hrci.org, Login and go to "My Online Profile" then click on the "Chapter Notification Link" and select "IN -- HR Assoc. of Central Indiana-0099" from the drop-down menu and then "Submit". Even if you have been certified for years, you should complete the chapter notification link to be sure that HRACI has accurate records of your accomplishment. Thank you for your cooperation!



PHR/SPHR Certification Study Groups Starting

Thinking About Taking the PHR or SPHR Certification Exam in December 2009/January 2010?

The 2009 Fall HRACI PHR/SPHR study groups will start mid-September. Classes will meet one (1) night a week in the evening from 6:00 pm to 8:30 p.m. for nine (9) weeks. We HOPE to have two (2) locations (depending on interest) -- northside and downtown.

In late July/early August, HRACI we will begin accepting online registrations for the HRACI study group(s) and each session/location will be limited to 25 participants. However, if you know that you’re interested -- send an email to Jennifer Lange (jennifer.lange@oldnational.com) and she’ll be sure to contact you when the registration link on HRACI’s website is live to ensure that you don’t miss it!

Again this Fall we are going to be using the HRCP study materials (this is NOT the same as SHRM Learning System) which includes six (6) study booklets covering each section of the exam, review questions and answers for each unit, and over 500 flashcards. To learn more about the HRCP materials, you can go to www.HRCP.com.

The cost for the program will be around $400 for HRACI members and $600 for non-members (specifics still TBD).

About the Speaker:
Dustin Stohler is General Counsel for the Department of Workforce Development. In that role, Mr. Stohler is chief legal counsel to the Commissioner. Additionally, Mr. Stohler oversees DWD's investigatory and oversight departments, as well as unemployment appeals. Prior to joining DWD, Mr. Stohler practiced law at Littler Mendelson and Baker & Daniels, where he advised employers on compliance with employment laws and defended employers in lawsuits and administrative proceedings brought under the NLRA, FLSA, Title VII, and other employment related laws. Mr. Stohler received a J.D. from Indiana University and a B.A. from Wabash College.
